These Terms of Service govern your access to and use of the Scanqur platform. Please read them carefully before creating an account or using any part of the service.
By registering an account or using the Scanqur platform in any capacity, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use Scanqur. These Terms apply to all users of the platform, including merchants who register an account and visitors who view published menus.
Scanqur is a web-based SaaS platform that allows merchants to create digital menus and product catalogs, generate unique QR codes, and make their offerings accessible to customers via those codes. Customers can browse published menus on any smartphone without downloading an application. The service is currently provided free of charge. We reserve the right to introduce paid plans in the future and will provide reasonable advance notice of any such changes.
To create a Scanqur account, you must provide a valid, functioning email address and choose a secure password. You must be at least 18 years old to register. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must not share your credentials or allow others to access your account. If you suspect that your account has been accessed without your authorisation, notify us immediately at contact@scanqur.com and change your password.
You agree to use Scanqur only for lawful, legitimate commercial purposes. You must not publish content that is illegal, harmful, defamatory, discriminatory, or that infringes the intellectual property or privacy rights of any third party. You must not attempt to probe or compromise the security of the platform, use automated tools to scrape or harvest data, or interfere with other users' access to the service. You must not create accounts for spamming purposes, impersonate other businesses, or publish false or misleading product information. Violations may result in immediate account termination.
You retain full ownership of all content you create on Scanqur, including your business information, menu categories, product names, descriptions, prices, and any image URLs you provide. By publishing your menu, you grant Scanqur a non-exclusive, royalty-free, worldwide licence to display and transmit your content to customers who access your public menu URL via your QR code. You represent and warrant that you have the rights necessary to publish all content you upload, and that such content does not infringe any third-party rights.
The Scanqur platform, including its design, interface, source code, trademarks, and all content produced by Scanqur, is the exclusive intellectual property of Scanqur and its creators. You may not copy, reproduce, modify, redistribute, or create derivative works from any part of the platform without prior written authorisation. Nothing in these Terms grants you any right, title, or interest in Scanqur's intellectual property.
Scanqur is provided on an 'as-is' and 'as-available' basis. We aim to maintain high availability but do not guarantee that the platform will be free of interruptions, errors, or data loss. We may carry out scheduled maintenance or emergency work that temporarily affects availability. Where possible, we will provide advance notice of planned downtime. We shall not be liable for losses arising from service interruptions beyond our reasonable control.
To the fullest extent permitted by applicable law, Scanqur and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including lost profits, lost data, or business interruption. Our total cumulative liability for any claim arising under these Terms shall not exceed the greater of: (a) the total fees you have paid to Scanqur in the twelve months preceding the claim, or (b) ten euros (€10).
You may close your account at any time by visiting the Settings page in your dashboard. Upon account deletion, your public menu will become immediately inaccessible, and all associated data will be permanently deleted in accordance with our Privacy Policy. We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion and with or without prior notice depending on the severity of the breach. Where termination is not due to a serious violation, we will make reasonable efforts to notify you in advance.
We may update these Terms of Service at any time. For material changes, we will notify you by email or through a notice on the platform at least 14 days before the new terms take effect. Your continued use of Scanqur after the effective date of updated Terms constitutes your acceptance. These Terms are governed by the laws of France. Any dispute relating to these Terms or the use of Scanqur shall be subject to the exclusive jurisdiction of the competent courts of France. For legal enquiries, contact us at legal@scanqur.app.
